When a Little Sale gets Big..... 

A walk in client came to us with a 5 acre parcel of property that they had inherited asking us to sell on their behalf. We did our usual Site Visit, Property Profile Report, and Appraisal,  which might we add is standard procedure for ALL our listings. Due DILIGENCE Always Pays....

Client reached out to us to confirm transfer of a property that they were making payments on, after they became suspicious when they were no longer able to find the seller when they wanted to make their final payment.  The Title presented for the property was a "Ministers Fiat Grant" but the Area had already been designated as Compulsory Registration Section. (Please note that Ministers Fiat Grant becomes invalid for Compulsory Areas). The proper Title for the Area Should have been a Land Certificate. Continued investigation showed that it was not transferred to anyone in the register and we even tried to contact seller to see if he would be willing to continue with the sale. Coincidentally during all this lengthy investigative  process  one of our other clients (a pawn broker) also provided us with a property that he was holding as surety for a loan that had been defaulted on.  he was exercising his right to acquire the property and transfer to himself. Guess what? it was the same property.  No one would have been the wiser as the lending party had not properly registered the loan with the Lands department via a Charge. 

This transaction highlights a lot of things but most importantly why Real Estate Transactions should be handled by Ethical Professionals.

2. Do you know what are the key elements of a sales agreement

3. Did you know that both seller and buyer must sign a sales agreement?
